The Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization will have a significant impact on health plan administration. Most if not all plans cover abortion services-in some cases it is limited to involuntary services required to preserve the health of the mother and/or rape, while other plans cover all voluntary abortions. And many plans cover abortion pills. Before the Dobbs decision, plans and their administrators did not pay much attention to the legality of these services because they were legal throughout the nation (up to a certain point). But now that the Dobbs decision makes each state the ultimate arbiter of whether an abortion is legal or not—and nearly half of the states do or intend to have a total or near total ban on abortions. This means plans that cover any abortion services must pay attention to where the services are being provided. This decision has raised many questions. In this session we will attempt to answer many of those, such as:
- Where are abortion services illegal?
- What services are illegal?
- Can plans that pay for abortions be liable under state law?
- Can administrators be liable under state law?
- Does ERISA preempt these state laws?
- Are travel reimbursement programs permissible?
- If they are, is the travel and lodging reimbursement tax free?
