This encore podcast will discuss the important issue of the potential erosion of ERISA preemption through the recent Supreme Court case, Gobeille v. Liberty Mutual and includes a discussion of the Sixth Circuit Court of Appeals Decision, SIIA v. Snyder.  What are the preemption rules after these important new decisions? Does ERISA still preempt “any and all State laws insofar as they may now or hereafter relate to any employee benefit plan”?  This presentation will explore the key exceptions to preemption and you will learn about the key issues reviewed by the Supreme Court on preemption of State law. 

Jason P. Lacey is a partner with Foulston Siefkin LLP in Wichita, Kansas, practicing in the areas of employee benefits, ERISA, and executive compensation. 

A frequent writer and speaker on employee-benefits topics, he is a contributing author to various manuals on Self-Insured Health Plans, Heath Care Reform, and 1094/1095 Reporting published by Thomson Reuters/EBIA and speaks regularly at EBIA seminars on topics including ERISA, consumer-driven health care, health care reform, and self-insured health plans. He is also a co-author of the Kansas Employment Law Blog.
