Following the U.S. Supreme Court’s ruling on June
26, 2015, regarding same-sex marriage, many government plans and private
employers will seek answers on how to enroll same-sex spouses and dependent
children in the same coverages and services as employees. Learn about the
options for employers in determining what they are required to do, and not
required to do, following the landmark decision.
In Windsor (2013) the Supreme Court struck down Section
3 of the Federal Defense of Marriage Act (DOMA) as an unconstitutional
deprivation of equal protection. The Obergefell v. Hodges case was a
compilation of six lawsuits in four states that defined marriage as a union
between one man and one woman. Reasoning that the fundamental rights protected
by the Fourteenth Amendment’s due process extended to personal choices, they
held that a state must license a marriage between two people of the same sex.
For employee benefits purposes, the Supreme Court’s
ruling says that same-sex couples are legally entitled to the same benefits
under federal law as all other married couples. This session will address the
impact these decisions have on employee benefits.
