The latest round of plan enrollments
generated numerous questions to the SPBA office about offering varying plan
options to different classes of employees.
Some employers expanded their offerings to bring in employees who had
not been invited to participate before.
The variations in these new offerings presented challenges in complying
with IRS nondiscrimination rules (IRC section 105(h)). This webinar will review the IRC section
105(h) nondiscrimination rules and discuss design issues that are potentially
problematic.

If all full-time employees are eligible for the same self-funded
employer-sponsored health plan options, will the plan be compliant with IRC
section 105(h) nondiscrimination rules?
If an employer classifies employees as
Exempt and non-Exempt, can different contribution levels be offered to these
classes as long as the actual benefits covered are the same?
Can different contribution strategies
be offered to union vs. non-union employees?
If all full-time employees are offered
the same benefits, can waiting periods differ for some employees?
An employer wants to continue to offer
coverage to those spouses already on the plan, but not allow more spouses to
enroll?
Benefits will remain the same for those
already on the plan, but for new hires, a different benefit package will be
offered. Is this permissible?
