In recent years, states have enacted a variety of laws governing AI, consumer data privacy, and the privacy of sensitive conditions such as gender affirming care.  Some of these laws do not apply to group health plans due to exemptions for HIPAA, whereas others potentially do and raise questions surrounding ERISA and preemption. This session will explore recent state AI and privacy laws and their interaction with HIPAA and ERISA.  The webinar will also discuss federal trends in AI and health privacy regulation.
