Measuring and Tracking Full-Time Employees under ACA Play or Pay
Employers subject to the Play or Pay rules need to determine which employees qualify as full-time employees for purposes of understanding potential liability under Code Section 4980H. The Patient Protection and Affordable Care Act (ACA) statutory language provides that a full-time employee is an employee who was employed on average at least 30 hours of service per week. The Employer Shared Responsibility proposed rules set forth optional safe harbors to use in determining whether or not an employee is full-time.
