Understanding the Mental Health Parity and Addiction Equity Act
Description: Effective for plan years beginning after Oct. 3, 2009, the Act requires private insurance plans covering 51 or more employees that offer mental health benefits as part of the coverage to offer such benefits on par with the medical surgical benefits. Any cost-sharing or benefit limits imposed on mental health services must not be any more restrictive than those imposed on med-surgical services. Under ERISA, the Public Health Service Act (PHSA), and the Internal Revenue Code, group health plans providing both medical and surgical benefits and mental health benefits cannot impose aggregate lifetime or annual dollar limits on mental health benefits that are not also imposed on substantially all medical and surgical benefits.
