TPAs and their client Employers will want to learn about the impact the HHS Nondiscrimination Regulations and ACA Section 1557 has on their business. Section 1557 was enacted as part of the ACA and the HHS Office for Civil Rights has been enforcing the provision since it was enacted in 2010.  The law prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs or activities. Section 1557 builds on long-standing Federal civil rights laws and extends nondiscrimination protections to individuals participating in:

Any health program or activity which received funding from HHS
Any health program or activity that HHS itself administers
Health Insurance Marketplaces, and all plans offered by issuers that participate in those Marketplaces.

This webinar will explore whether TPAs and their client employers have responsibilities under these new Regulations.

>>Learn what health plan and/or administration changes are likely required to avoid discriminating on the basis of sex.  Does a plan have to cover all services related to gender identity disorder?   Can a plan limit the amount of services provided for gender identity disorder?
 
>>Learn the types of auxiliary aids and language assistance that must be provided to plan participants.  Do I have to print plan documents in braille?  Do I have to provide translations of written plan related documents?
 
>>Learn the notice requirements and the plan related documents to which the notice requirements apply.   Do the notice requirements apply to EOBs and claim denial letters?  SBCs? SPDs?
 
>> Learn about the liability for failure to comply.  Are there penalties?  Private right of action?
