This webinar will provide an overview of the proposed rule (“Proposed Rule”) recently issued by the Equal Employment Opportunity Commission (“EEOC”) under Title II of the Genetic Information Nondiscrimination Act (“GINA”) with regard to wellness programs.  The Proposed Rule provides guidance on the extent to which an employer may offer an employee inducements for the employee’s spouse to provide information about the spouse’s current or past health status as part of a health risk assessment (“HRA”) administered in connection with an employer-sponsored wellness program.  We will explore the requirements under the Proposed Rule, and we will examine how the Proposed Rule interacts with other guidance applicable to wellness programs, including the final rule under the Health Insurance Portability and Accountability Act (“HIPAA”) and the proposed rule under the Americans with Disabilities Act (“ADA”). We will briefly discuss the continuing areas of uncertainty under Title I of GINA.
