The ACA Employer Shared Responsibility (Pay or Play) final regulation includes complex rules for identifying full-time employees for purposes of determining which employees need to be offered coverage to avoid penalty taxes.   The rules offer different methods for identifying full-time employees that TPAs need to understand and explain to their clients.  Our prior webinar (Part I) on this topic (first aired on April 30, 2014) focused on the definition of "hour of service" rules and how the measurement methods differ for ongoing employees vs. new variable hour employees.

Learning Objectives

  • Learn when an initial measurement period can be used and the options it gives employers.
  • Understand the pros and cons of using the monthly measurement period and which employers are candidates for the monthly measurement period.  Understand the pros and cons of the monthly measurement period.
  • Learn to apply the measurement, stability, and administrative periods; despite the flexibility, what is recommended and why.
  • Learn how to handle a change in employment status, or a leave of absense during an initial measurement period; during a stability period.
  • Understand how the measurement methods impact the penalties.  For example, which employees under each method qualify as a full-time employee in a month and which ones qualify as a full-time employee to whom coverage must be offered in order to avoid excise taxes.
