Incentives for Nondiscriminatory Wellness Programs
In early June final regulations on incentives for nondiscriminatory wellness programs were released.  These final regulations increase the maximum permissible reward under a health-contingent wellness program from 20% to 30% of the cost of coverage and they further increase the maximum permissible reward to 50% for wellness programs designed to prevent or reduce tobacco use.  


Learning Objectives
  • Navigate the new HIPAA wellness regulations and understand the new participatory v. outcome-based wellness program framework.
  • Evaluate potential issues related to wellness programs under the ADA, GINA and ERISA.
  • Review common wellness program structures and appropriately classify a program as an outcome-based or participatory program.
  • Understand the new requirement to provide a reasonable alternative standard for outcome-based wellness programs and evaluate the role of a physician in designing a program.
