Play or Pay Plan Design Issues
This webinar will serve as the companion to January’s webinar on the Play or Play rules.  For those who missed the January webinar, this webinar can also stand on its own as the Play or Pay rules will be reviewed in relation to plan design issues. 
  

Learning Objectives

Below are some of the issues that will be addressed:

  • Can an employer reduce hours of some full-time employees to avoid penalties in 2014?  If so, when does the reduction in 2013 need to occur?
  • How should employers approach plan design in terms of employee contributions to avoid the No-Offer-to-All-Full-Time Employee Penalty?  Should employee contributions for employee-only coverage be based on the lowest paid employee?
  • Should employers consider offering a plan but making it “unaffordable” for a portion of the workforce?
  • Will employers be required to show proof that employees have coverage, either through the employer-sponsored plan or a spouse’s employer-sponsored plan to avoid a penalty?
  • If an employee declines coverage due to coverage under a spouse’s plan, will a penalty apply to the employer?
  • Can an employer carve out coverage for a certain class of employees and only be subject to penalties on the class not being offered coverage?
  • Will employers contributing to a Taft-Hartley plan be considered to be providing an “affordable” plan?
  • Is balance billing included in the determination of minimum value as it relates to the affordability provisions?
  • Is a standalone HRA subject to all ACA provisions (i.e., EHB, annual limits, etc.)?
